The employer failed to provide a respirator that is at least as effective as an N95 filtering facepiece respirator, unless the employer's evaluation of respiratory hazards determines that a more protective respirator is necessary. The employer failed to implement an effective COVID-19 Prevention Program, in that, the employer did not provide effective training and instruction to employees that including, information regarding COVID-19-related benefits to which the employee may be entitled under applicable federal, state, or local laws, which include any supplemental paid sick leave benefits available under the federal Families First Coronavirus Response Act.
