California Code of Regulations, Title 8, Section 3203(a)(4) and (6). Injury and Illness Prevention Program. The Employer is not enforcing social distancing so that employees stay at least six-feet apart to reduce their potential exposure to the COVID-19 virus. Due to the nature of the work employees perform in the warehouse, social distancing is not feasible for these employees. California Code of Regulations, Title 8, Section 3380. Personal Protective Devices. The Employer does not enforce the use of face coverings at the workplace. Complainant notes: Several EEs have tested positive for COVID-19. The caller's son is afraid to say anything. Mom is scared he may bring it home. ER not an essential business. It took too long for ER to provide COVID-19 test for her son. All of the other EEs received their test before he did. ER gives EES masks and gloves, but EEs cannot social distance in the warehouse. 2-3 EEs have to go inside a trailer to remove items - no social distancing. Do not enforce wearing mask. ER only recently gave EEs masks and gloves.
