Employer failed to establish, implement and maintain an effective Injury and Illness Prevention Program. The employer failed to implement a system to ensure employees complied with safe and healthful work practices. The employer failed to draft a written system for identifying and evaluating workplace hazards. The employer did not have methods or procedures for correcting unsafe or unhealthy conditions and work practices in a timely manner related to COVID-19. The employer failed to encourage employees to inform employers of workplace hazards without fear of reprisal. T8 3203(a) Employer retaliated against PII after he complained that working with patients who potentially carried COVID 19 without a facemask or gloves with or without symptoms violated state and federal guidelines. T8 3203(a)PII was retaliated against for reporting a sink intended for hand washing lacked soap to prevent the spread of COVID 19. T8 3203(a) T8 3366(b) PII was discouraged from wearing PPE because it might cause patients or other employees to panic. On March 30, 2020 PII returned to work wearing a painter's mask, gloves and safety goggles over his prescription eyeglasses. PII was confronted by his employer who objected to the PPE he was wearing. Two weeks later PII was terminated without cause. T8 5199
