Where the employer is not exempt from the COVID-19 Emergency Temporary Standard by 1910.502(a)(2)(v), in that, employees are not required to be vaccinated, patients and family members are not screened before employee's entry into the home, and patients with confirmed COVID-19 are present; Item #1: The employer does not require employees to quarantine or get tested after exposure to patients who have tested positive for COVID-19. Employees are given the option to continue working with the positive patient, work with another patient, or to quarantine without pay and benefits. Item #2: The employer failed to implement a procedure to screen and triage patients and non-employees when employees are entering the home. Item #3: Employees who choose to quarantine after exposure to patients who have tested positive for COVID-19 are not paid for the time absent from work.
