The specific nature of the alleged hazards are as follows: 1. The employer does not ensure when multiple employees are occupying a vehicle for work purposes, these controls are enforced: 1. Eliminate the need for employees to share work vehicles; 2. Provide access to fresh air ventilation (windows), No recycled cabin air 3. When physical distancing cannot be maintained, establish procedures to maximize separation during travel; 4. When employees must share work vehicles because no other alternatives are available, employees shall be provided with respiratory protection, such as N95 filtering face piece respirator. The employer shall ensure compliance with respiratory protection, and personal protective equipment; 5. Until adequate supplies of respiratory protection and/or personal protective equipment become readily available for non-medical and first responder employers and employees, employers shall provide and employees shall wear face coverings while occupying a work vehicle with other employees or persons. 2. The employer does not clean, nor sanitize all common spaces and frequently touched surfaces at least once per shift, daily, or once every 12 hours (shared common areas & touch points: shared tools & equipment, vehicles, phones, port-a-johns, etc.). 3. The employer does not notify their employees of a COVID positive case within 24 hours of discovery of a positive case, including contractors whose workers are at the same worksite. 4. VOSH (ETS) became a Permanent Standard on January 27, 2021.
