California Code of Regulations, Title 8, Section 3203(a)(4) and (6). Injury and Illness Prevention Program. The Employer is not taking measures to protect employees from exposure to the COVID-19 virus, as follows: - The Employer is not enforcing social distancing so that employees stay at least six-feet apart from customers and other employees to reduce their potential exposure to the COVID-19 virus. Customers stand less than 6-feet away from Cashiers, and there is no plexiglass barrier between Cashiers and customers. In addition, cash registers are positioned less than 6-feet apart, and therefore Cashiers are working less than 6-feet apart from each other. - The Employer is not providing employees with an effective disinfectant to clean shared work areas in the store: the Employer provides employees with a 30% alcohol solution to clean the shared surfaces, which is not in accordance with CDC Guidelines. California Code of Regulations, Title 8, Section 3380. Personal Protective Devices. The Employer does not provide effective face masks for employees. Complainant notes: -ER uses 30% alcohol solution to disinfect the store, instead of the CDC-recommended 60% alcohol solution. EE brings her own cleaning supplies from home. -No social-distancing of at least 6-feet apart b/ Cashiers and customers: No plexi-glass at the cashier stands, or no effective protection (there is plexi-glass at one cashier, but it does not protect Cashier - just covers the customer credit card keypad). ER told EE that they ordered plexi-glass for the cashier stands, however they have not received them yet. -No social distancing b/ customers and EEs, and between EEs during Housewares 1-day home sale EEs crowded together no social distancing. EEs were unable to work 6-feet apart. Registers too close for social distancing b/ EEs (C asked we do not mention a specific Department to ER). -The mask ER gave EEs is too thin/not effective EEs were given masks not adequate (can smell through them). -ER take customer returns placed on rack behind them. The returned clothing stays on the rack for only one day and is returned to inventory, instead of staying on the rack for at least 3 days.
