California Code of Regulations, Title 8, Section 3203(a)(4) and (6). Injury and Illness Prevention Program. The Employer is not taking measures to protect employees from exposure to the COVID-19 virus, as follows: - The Employer is not enforcing social distancing so that employees stay at least six-feet apart to reduce their potential exposure to the COVID-19 virus inside the lunch room. - The Employer is not enforcing the use of protective masks inside the lunch room. - The Employer is not effectively screening employees for signs of symptoms of the COVID-19 virus. For example, an employee went home complaining of a sore throat and the Manager allowed the employee to work in the store the following day without a COVID-19 test or quarantine. - The Employer is not effectively disinfecting common areas like the lunchrooms, restrooms and fitting rooms. - The Employer is not enforcing customers to wear face coverings. For instance, customers are allowed to remove their face coverings to smell perfume. - The Employer is not limiting the number of customers allowed inside the store. Complainant notes: -EE coughed in lunch room. 100 EEs share it. EEs are not wearing masks eating lunch. Aerosols can travel ¿ it¿s like an indoor restaurant. -Perfume on a card. The they take off mask to smell perform -No limit of number of customers into the store ¿ no control of this. Fathers day was very busy.
