1. The employer failed to ensure all existing and potential hazards are eliminate or control such as engineering, administrative, and personal protective equipment within the workplace in a timely manner. The Bus passengers not complying with State of Hawaii, Governor Ige's COVID-19 Emergency Proclamation and Kauai Mayor's Emergency Rule , requiring face covering and implementing social distancing measures potentially exposing the bus drivers to COVID-19 (SARS-CoV-2) hazards. 12-60-2(b)(2)(A). 2. Employees were not provided with an effective information and training on hazardous chemicals in their work area. The employees do not know the hazards associated with the chemicals that were used to clean and sanitize the Bus. 29 CFR 1910.1200(h)(1) [Refer to 12-60-50(a), HAR] 3. The employer failed to develop, implement, and maintain the hazard communication program at the workplace for the bus drivers. 29 CFR 1910.1200(e)(1) [Refer to 12-60-50(a), HAR]. 4. The employer failed to provide the safety data sheets of hazardous chemicals that were used by employees at their workplace. 29 CFR 1910.1200(g)(8) [Refer to 12-60-50(a), HAR] 5. The employer failed to ensure that the secondary container of hazardous chemicals used when clean and sanitize the bus are labeled. 29 CFR 1910.1200(f)(6) [Refer to 12-60-50(a), HAR] 6.
