T8 CCR 5199(g)(4)(A-H) Employer is exposing employees to COVID-19 positive patients during surgery prep/surgery activities. Employees are directed to only use surgical masks while working in close proximity to patient's breathing zones unless the patient test positive for COVID-19 withing 72 hours of surgery. One patient was awaiting the COVID test result later indicated the patient had been positive for covid while being prepped. Second patient had a test result that was positive, but the positive covid test was ignored because the patient previously had covid in months prior and the person in charge assumed it was a false positive result instead of testing the patient for covid again. Employees were directed to continue with perp and surgery for the patient without obtaining a negative covid test. Employer does not have an effective system in place to treat all patients that do not have negative test results for covid at the time of surgery as a suspected covid-19 case and to take covid-19 precautions until a negative test result is obtained.Source: Osha.gov | Receipt Date: 2021-03-11
