1. The employer failed to provide the employees with NIOSH approved CAPRS in the 4W and Emergency Department in that the faceshields were either missing or had to be taped with duct tape for pressure bandage tape. T8 CCR 5199(g). 2. The employer failed to provide the employees with a powered air purifying respirator (PAPR) with a High Efficiency Particulate Air (HEPA) filter(s) or a respirator providing equivalent or greater protection in the absence of CAPRs that are either missing shields or taped while performing high hazard procedures and AirD cases or suspected cases in the Emergency Department and 4W. T8 CCR 5199(6)(A). 3. The employer failed to ensure the medical staff working in 4W and the Emergency Department were fit tested on the same size, make, model and style of respirator as the employee will use. T8 CCR 5199(d)(2)(E). 4. The employer failed to enforce work practice controls to limit employees exposing non infected patients to a virus by assigning nurses.
