Employees work on the 10th floor of the Indiana Government Center North building. The west end bathrooms have all been closed until further notice and the only restroom that we have available to use is the Gender Neutral bathroom. We are unable to use the east end bathrooms because we are not allowed to enter IDEM's area to pass through to the east end. If the gender neutral bathroom is occupied, we must use the elevators to travel to a different floor or use the stairs if we are physically capable of doing so. The IOT Helpdesk has been required to return to work in half capacity of around 12 to 14 employees for just our office. There are 3 other agencies that also share the 10th floor with us. Looking at the osha.gov website at 1910.141(c)(1)(i), employers must provide a minimum number of toilet facilities, in toilet rooms separate for each sex, and prompt access to the facilities when needed. According to the J-1 table an employer must provide a set number of restroom facilities in relation to the number of employees. A single restroom facility is only adequate for up to 15 employees and since we cannot control how many other individuals are on this floor, we are likely over the single restroom facility limit. The issue is of even greater concern due to Covid-19 and the likeliness of spread of this disease due to it not being sanitized more due to the high influx of use in that facilitiy.
