Per complainant: See attached CCR,Title8, 3205(c) COVID-19 Prevention Program Employers shall establish, implement, and maintain an effective, written COVID-19 Prevention Program. Employees are not wearing masks in common areas. Beginning on or about January 7, 2021 and continuing to date, Allied has had individuals, who are not employed out of the Santa Maria, CA facility and who are performing absolutely no actual delivery work, riding in the cabs along with the Santa Maria, CA delivery drivers. These individuals who are riding along with the employees are not six feet apart from the employees, as required by the Emergency Temporary Standard and state guidelines. Failure to Allow the Employees to Socially Distance in the truck cabs:As of January 7th, 2021, management requires drivers to have another individual in the cab of their truck. This new company policy does not allow for employees to keep 6 feet distance from one another in an enclosed space. Failure to santize trucks between drivers; trucks are alternated amongst the drivers, without santizing in between uses. Management is requiring the employees to attend in-person meetings that were not in place prior to the pandemic and can be held remotely.Failure of employer to update and make available the Injury and Illness Prevention Program (IIPP) to integrate Cal/OSHA guidance regarding COVID-19 and comply with AB 685. The employer has also failed to notify their employees and the Union of positive covid-19 cases, Currently there are no protocols in place once a worker has tested positive for COVID-19, there is Insufficient sanitizing of the trucks in between uses, limited personal protective equipment is being provided, and allied has failed to institute social distancing. California Labor code § 6309, with a request that Cal/OSHA conduct a thorough on-site inspection of this site.
