The employer is not following the Centers for Disease Control and Prevention (CDC) guidelines to protect employees from exposure to SARS-CoV-2, the virus that causes COVID-19, specifically, the employer is not following the CDC guidelines for " Guidance for Businesses and Employers Responding to Coronavirus Disease 2019 (COVID-19), Prevent and Reduce Transmission Among Employees, Take action if an employee is suspected or confirmed to have COVID-19" in that the employer does not inform employees who have had "Close Contact" (within 6 feet of an infected person for a cumulative total of 15 minutes or more over a 24-hour period) with someone with confirmed or suspected SARS-CoV-2 infection in the workplace [while maintaining confidentiality as required by the Americans with Disabilities Act (ADA)]. 2. The employer is not following the Centers for Disease Control and Prevention (CDC) guidelines to protect employees from exposure to SARS-CoV-2, the virus that causes COVID-19, specifically, the employer is not following the CDC guidelines for " Guidance for Businesses and Employers Responding to Coronavirus Disease 2019 (COVID-19), Prevent and Reduce Transmission Among Employees, Consider conducting daily in-person or virtual health checks", in that the employer does not conduct daily in-person or virtual health checks such as symptom and temperature screenings with employees, prior to beginning work.
