1. There are roughly 15 employees currently being forced to work in the building that are 100% remote-capable and are not involved in hands-on production work. The employer's response to a previous MIOSHA complaint regarding violations of remote-work rules was that remote-capable employees are needed in the building "for efficient/effective production". This is in violation of rule 5(8) as these employee's work has previously been done per the rule's "feasibly" requirement, and the work duties have not changed. In forcing employees that are remote-capable to be physically present in the workplace, the employer is required to have performed an analysis showing that the work that was done for several months was infeasible, and this must be a written policy. The employer does not have this analysis nor written policy in their Covid-19 preparedness and response plan.Source: Osha.gov | Receipt Date: 2021-01-14
