The employer did not maintain an effective injury and illness prevention program in that the employer did not ensure that COVID-19 precautions per the state executive and local public health department orders are being followed at the workplace in the following instances: Description of complaint: Employees working in containers not being able to distance properly. 1. The employer did not ensure to implement and maintain an effective procedure for reducing the risk of transmitting aerosol transmissible diseases. 5199(c)(3) 2 (5).  Description of complaint: Screening of patients is being conduced with thermometers which are not working properly and/or screening patients in the weather which can give an incorrect temperature reading. 2. The employer did not ensure to implement and maintain an effective procedure for screening incoming patients. Ref T8CCR 5199(c)(3). Description of complaint: Inside the connex boxes where employees stage themselves for COVID-19 testing the HVAC system for heating or cooling during winter/summer months does not work properly. 3. The employer did not ensure that the HVAC system was maintained and operated during working hours. Ref T8CCR 5142(a)(2).
