they had a COVID case in the workplace but no contact tracing was conducted or COVID testing of employees. Chicago Public Schools has a testing and vaccination policy for student athletes. Employees are reporting that the administration is not following that safety policy, by not informing employees if any athletes are vaccinated or are being tested for COVID creating a COVID Hazard for employees. On August 11, 2021, The Illinois State Board of Education (ISBE) issued a letter to all superintendents titled, "Enforcement of Universal Masking Requirement." This letter highlights Executive Order 2021-18, that requires that all students, staff, and visitors wear masks indoors in all P-12 schools in Illinois. All School Personnel must have, at a minimum, the first dose of a two-dose COVID-19 vaccine series or a single-dose COVID-19 vaccine within 10 days after issuance of this Executive Order, and be fully vaccinated against COVID-19 within 30 days following administration of their first dose in a two-dose vaccination series. Any School Personnel who have not established that they are fully vaccinated against COVID-19 must be tested consistent with the requirements of Subsection (d). To establish that they are fully vaccinated against COVID-19, School Personnel must provide proof of full vaccination against COVID-19 to the School. While IL OSHA cannot directly enforce this executive order, the Illinois Occupational Safety and Health Act requires employers to protect employees from recognized hazards that cause or are likely to cause death or serious physical harm to its employees (820 ILCS 219/20(a)). Employers that violate this section of the Act may be cited and/or referred to another regulatory authority such as the ISBE.
