1. Employees in the maintenance department are not provided with an adequate supply of water for drinking and washing. T8 CCR 3363(a) 2. Employees in the maintenance department are not provided with accessible restrooms. Where practicable, toilet facilities should be within 200 feet of locations at which workers are regularly employed. T8 CCR 3364(b) 3. The employer failed to establish and implement a written hazard communication program. The employer does not maintain and make safety data sheets for chemicals used at the jobsite accessible to employees, and employees are not provided training on hazardous chemicals in their work areas. T8 CCR 5194(e)(1) 4. The employer failed to establish and implement a written bloodborne exposure control plan to protect employees who have exposure to contaminated sharps, blood, or other potentially infections material in the workplace and the proper disposal of sharps containers. T8 CCR 5193(c)(1)(A)&(d)(3)(E) 5. Employees operating elevating work platforms (scissor lifts) are not instructed by a qualified person in the safe use of the work platform in accordance with the manufacturer's operating instructions, and Section 3203, Injury and Illness Prevention Program. The employer failed to ensure that the elevating work platform is used in accordance with the manufacturer's instructions. The employer allows employees to lift equipment which extends beyond the rails of the elevating work platform. T8 CCR 3646(b)&(l) 6. Employees operating powered industrial trucks (forklifts) are not certified as competent to operate powered industrial trucks safely. T8 CCR 3668(a)(1) 7. The employer failed to perform a hazard assessment and Personal Protective Equipment (PPE) selection for employees working in the maintenance department. The employer failed to provide PPE to these employees. T8 CCR 3380(f) 8. The employer failed to implement and establish a written and effective Heat Illness Prevention Plan to protect employees who work outdoors. T8 CCR 3395(i) 9. The employer failed to offer COVID-19 testing at no cost to employees during their working hours to all employees who had potential COVID-19 exposure in the workplace and provide them with the information on benefits described in subsections (c)(5)(B) and (c)(10)(C). T8 CCR 3205(c)(3)(B) 10. The employer failed to make the written COVID-19 Prevention Program available to employees immediately upon request. T8 CCR 3205(9)(D)

Risk Statement: In the population most at risk, immunocompromised population, there is a reasonable probability that microbial contamination of Atovaquone Oral Suspension can result in disseminated, life threatening infections such as endocarditis and necrotizing soft tissue infections.

Atovaquone Oral Suspension, USP is indicated for prevention and treatment of Pneumocystis jiroveci pneumonia (PCP) in adults and children 13 years of age and older who cannot tolerate other medicines, such as trimethoprim-sulfamethoxazole.

The product is packaged in a carton. The identified NDC # associated with the product is 50268-086-12, UPC # 5026808612 and the affected lot# is AW0221A with an expiration date of 08/2025.

AvKARE, LLC is notifying its distributors and wholesale customers by mailings and email communications method and is arranging for returns of all recalled Atovaquone Oral Suspension, USP. Wholesalers who have Atovaquone Oral Suspension, USP 750mg/5mL, which are being recalled, should examine their inventory and cease dispensing, return any of the impacted lots to AvKARE, LLC. Consumers that have product which is being recalled should stop using the product and return it to place of purchase.

This recall is being conducted with the knowledge of the U.S. Food and Drug Administration.
