“The employer had not identified and addressed the hazard posed by COVID-19 in the workplace in the following way: 1. The employer does not require and enforce physical distancing and allows employees to work within 6 feet of each other. Desks are set up with workstations within 6 feet of each other... See Moreand are directly adjacent to active aisle ways. Employees in meetings don't maintain physical distancing. Employees frequently disregard the maximum occupancy sign on the lunchroom. 2. The employer does not require and enforce the use of face coverings in the workplace. Employees working next to aisle ways where other employees frequently pass don't wear face coverings. Some employees wear face coverings but then pull them down to speak. 3. The employer does not ensure that commonly touched surfaces are sanitized. In practice, employees do not wipe down and sanitize shared workstations when they leave. There is no policy or enforcement to ensure these shared workstations are sanitized. Ref. Title 8 CCR 3203(a)(4)(6).
